Our medical negligence solicitors settled a claim for a delayed diagnosis of breast cancer for our client, Anna*. We were able to secure £780,000 in compensation for her.
What happened to Anna?
Anna made an appointment to see her GP after finding a lump in her left breast. The GP assured her that the lump was nothing to worry about and didn’t carry out any further investigation.
More than two years after the initial appointment, Anna was diagnosed with breast cancer. This diagnosis came much later than it could have, resulting in surgery and chemotherapy, which would have been avoided.
Anna was left with lasting impact as a consequence, including a reduction in her life expectancy.
How did Irwin Mitchell’s medical negligence solicitors help?
Anna contacted our medical negligence team to seek compensation for her delayed diagnosis of breast cancer.
The impact of the treatment meant that Anna’s career took a very different course, including reducing to part time work. Prior to the negligence, Anna enjoyed a successful career.
We began work by getting evidence from independent medical experts. Their opinion helped to prove that Anna’s diagnosis had been delayed due to negligence on her GP’s part.
We prepared a Letter of Claim and the GP responsible admitted liability for the delayed diagnosis. Proceedings were issued and Judgment entered in Anna’s favour. We also begun collecting the evidence to quantify the claim.
Our evidence determined on the balance of probabilities that Anna’s breast cancer would recur and is likely to be fatal. This could have been avoided if she’d been diagnosed and treated sooner.
A £780,000 settlement
We successfully settled Anna’s claim for £780,000 and whilst the compensation cannot change what has happened, it will give Anna the financial means needed to access treatment and make up for her lost earnings
Jasicca Nava, an associate solicitor in the medical negligence team, handled Anna’s claim. Speaking of this case, Jasicca commented:
“No sum of money will be enough to compensate Anna’s pain and suffering, but I’m glad we have been able to secure compensation to ease some of the worry caused by the negligence.”
Client feedback
After her claim was settled, Anna said: “I was delighted with the outcome and with the way that Irwin Mitchell handled my case.
“Jasicca and her team have been fantastic right from the very beginning and have been patient, communicative and understanding of my circumstances.
“The settlement has provided me with some much-needed closure, and I can now get on with my life.”
