What can I do if my child doesn’t have access to my grandchildren?

If your son or daughter doesn’t have access to their children, it can be difficult – but not impossible – for you to get access to them. 

A court rarely decides a parent shouldn’t have access to their child. This only usually happens if they’ve serious concerns about a parent's ability to care for the child or the child's safety.

However, a decision about whether a parent should have access isn’t a decision about whether a grandparent should have access. You can go through a legal process to try to maintain contact with your grandchildren, and we’ve experience helping grandparents in this position.

Can grandparents get custody of their grandchildren?

If you think your grandchildren’s best interests would be served by living with you, rather than their parents, or if their parents are unable to care for them you can apply to get custody (known as a “live with” order).

Before you can apply for custody of your grandchild, the court must first give you permission. You then apply for a child arrangements order, which will determine with whom your grandchild will live.

We often help grandparents and other extended family members obtain custody in situations where parents are unable to care for their children – perhaps through ill-health or other reasons. Our lawyers have extensive experience in this area and can help you to:
