Sorin Stockert 3T Heater-Cooler Claims

Trustpilot

Health officials are contacting patients around the world after Sorin Stockert 3T Heater-Coolers used during heart surgery have been linked with potentially fatal infections. If you’ve fallen ill following heart surgery or have received a warning letter from your hospital, we may be able to help you make a compensation claim.

Sorin Stockert 3T Heater-Coolers are used to keep patients at the right temperature during heart surgery and other complex surgical procedures.

It’s believed that some of these devices have become contaminated with bacteria, including Mycobacterium chimaera (M. chimaera), and that the devices are passing bacterial infections on to patients.

M. chimaera infections can be fatal. Symptoms include:

  • Night sweats
  • Joint/muscle pain
  • Weight loss
  • Fatigue
  • Unexplained fever.

The bacterium is very resistant to antibiotics and extra surgery may be needed to replace implants if they’ve been infected. It’s estimated that 47,000 patients may be at risk of infection following heart surgery using Sorin Stockert 3T Heater-Coolers.

Warnings have been sent to all patients who’ve had valve operations since January 2013 and who may be at risk of developing the infection. If you’ve received a warning letter or believe you’re at risk, we may be able to help you claim compensation and make sure that you get the medical care you need. Contact us today to find out more.

More information on Sorin Stockert 3T Heater-Cooler claims

To find out how much your claim could be worth, speak to us today.

Every claim for compensation is unique, so we can’t give you an estimate of how much you may be entitled to until we know more about your case.

The amount of compensation you’re awarded will be based on:

  • Your pain and suffering
  • Any loss of earnings you’ve had through being unable to work
  • Expenses you’ve incurred, such as medical and travel expenses for hospital appointments
  • Your prognosis and future care needs
  • Any modifications you need making to your home
  • Any specialist care or equipment you need.

You’ll normally have three years to make a claim. This time limit begins from the date of your operation. If you didn’t find out until later that your illness was caused by negligence, the three-year time limit starts on the date you learned this.

The three-year limit doesn’t apply to children under 18 years and people who lack the mental capacity to make their own decisions.

It’s always best to start the claims process as quickly as possible after the incident. The evidence will be easier for us to gather and events fresher in people’s minds. This helps to give your claim the best chance of succeeding.

We’ll always work to settle your Sorin Stockert 3T Heater-Cooler claim as swiftly as possible. However, the length of time a claim takes can depend on several factors.

One of the major factors is whether the party responsible for your negligence admits blame. If they accept responsibility straight away, we can settle your claim and you’ll be awarded compensation.

But if they dispute blame or how much compensation we feel you need, we’ll initiate court proceedings. This means your claim will likely take longer to settle, as we’ll need to work to prove they’re to blame. If necessary, we’ll use independent medical experts to help support your claim, alongside the medical evidence and witness statements we’ve already gathered.

However long your claim takes, we won’t rest until it’s been settled. If we need to go to court, we’ll make sure we’ve the strongest possible case and that you’re as prepared and comfortable as possible.

Many compensation claims can be settled out of court even if trial dates have already been set.

Yes, most of our medical negligence claims use no win no fee agreements. If you’re eligible to make a no win no fee claim, you won’t need to pay anything upfront.

You’ll only need to pay any fees if your claim is successful, and most of our fees will be paid by your opponent. If your claim doesn’t succeed, you won’t need to pay anything.

You’ll need a suitable insurance policy (ATE insurance policy) to be able to make a no win no fee claim. We’ll discuss the finer points, along with alternative funding options, before we start working for you.

Frequently Asked Questions

What are Sorin Stockert 3T Heater-Coolers?

Sorin Stockert 3T Heater-Cooler systems are used to heat and cool patients during heart surgery and other cardiac procedures. They were originally manufactured in Germany by Sorin Group Deutschland GmbH, which has now merged with an English-based company, LivaNova.

Before surgeons can operate on a heart, they must first stop it beating.

The main way to do this is to divert the patient’s blood away from the heart with a heart-lung machine and then pump a cool solution through the heart. The cold solution also slows the heart’s metabolism to prevent cell death while it’s isolated from the blood. This is known as cardioplegia.

There are certain procedures that involve chilling the patient into a controlled hypothermic state during surgery and warming them back up again afterwards.

The Sorin Stockert 3T Heater-Cooler is used along with other devices. This keeps patients, their blood, and the cardioplegic solution all at their desired temperatures throughout surgery.

The device contains tanks of temperature-controlled water that’s pumped through closed circuits into warming/cooling blankets or external heat exchangers. At no point does the water come into direct contact with the patient.

How do Sorin Stockert 3T Heater-Coolers cause infection?

Several patients have been infected with a type of bacteria called Mycobacterium chimaera after undergoing surgery with a Sorin Stockert 3T Heater-Cooler in use. A European study has since found a link between the infections, the heater-cooler devices, and the manufacturer’s factory in Germany.

M. chimaera is commonly found in soil and water. It shouldn’t be present in sterile environments where medical equipment is manufactured. However, tests done by the manufacturer found that both its production line and water supply had been contaminated by the bacteria.

Several more recent studies have also linked the Stockert device to other dangerous infections, including Mycobacterium Abscessus and Legionella.

What is a group claim?

A group claim is when several people affected by the same defective medical product claim as one party.

Making a group claim means the court won’t need to hold separate trials for individual claims. A big benefit for claimants is that you can share legal expertise and expenses. If a group claim is appropriate and possible, the process may be cheaper and swifter for you and your fellow claimants.

Working together can help to maximise your chances of being fully and fairly compensated for the medical negligence you received.

Our lawyers have a great deal of experience in handling group claims. We continue to secure more compensation in medical negligence claims than any other law firm in the UK. Speak to us today about whether it’s possible for you to make a group claim.
