Cow Accident Claims - More Information

If you’ve been injured by a cow, it’s important to contact us as soon as possible.

To help support your claim, you should:

  • Keep a record of the police incident number if you have one.
  • Get the name and address of the farmer, landowner or owner of the cow.
  • Collect contact details from any witnesses who saw what happened.
  • Keep records of any medical appointments you attend.
  • Keep receipts for prescriptions, travel, and medical costs you’ve had to pay
  • Take photos of your injuries immediately after the incident if possible, and any scarring that follows.

We understand that when you’ve been injured, your first concern isn’t collecting evidence. When we take your claim, we’ll start by collecting any other evidence you might’ve missed.

When you first contact us about your cow accident claim, we’ll take time to learn more about what happened to you or your loved one. It’s also at this point we’ll discuss funding options with you, such as no win no fee claims.

Our experts will start by gathering evidence about your injuries. We’ll gather evidence such as medical reports, witness statements, and CCTV if available. If appropriate, we’ll use independent medical professionals to assess your injuries and how they’ll affect your life in the future.

We’ll then take your cow accident claim to the owner of the cow. If they accept fault and agree with the compensation amount, we’ll work to get you interim payments to help cover any costs you’ve already had. Any interim payments will be taken away from your final compensation amount.

Every cow accident claim will receive a different amount of compensation depending on things like:

  • Expenses – including travel expenses to medical appointments, medical equipment, and things that help with practical day-to-day living.
  • Loss of earnings – to cover any time you’ve had off work and time off you may need in the future. This figure can also cover matters such as not returning to the same role or not being able to return to work.
  • Pain and suffering – caused by your injury or illness.
  • Rehabilitation – to help provide the necessary rehabilitation for your recovery and well-being.
  • Adaptations – any adaptations needed e.g. to your home or car. 
  • Care – to provide for any care and support you may need.

For a cow accident injury, you’ve got three years from the date of the accident to claim compensation.

There are some exceptions to this three-year limit. These are:

  • Claims on behalf of children – these can be made at any point before their 18th birthday. When the child reaches 18, they can make their claim at any stage up until their 21st birthday.
  • Mental capacity – there are no time limits to claim on behalf of someone who can’t make their own claim.
  • Fatal claims – to claim on behalf of your loved one, you’ll have three years from the date they died to make a claim.

In most cases you can make a no win no fee cow injury claim. You’ll need to set up an insurance policy, at no added cost, to protect you should your claim be unsuccessful. If your claim is unsuccessful, you’ll have nothing to pay.

How does the Animals Act 1971 affect my claim?

Under the Animals Act, any person who keeps animals may be found strictly liable for the harm or injury caused to other people.

This means that if a cow injures you, you can potentially make a compensation claim against the owner.

The Animals Act is often criticised for being difficult to navigate, as it often seems ambiguous or unfair. As specialists in cow injury claims, we know the ins and outs of the Animals Act very well. We’ll listen to what happened to you, and we can tell you if you have a claim.

Can I claim if I was injured by a cow at work?

Although cows are generally docile, they can be unpredictable, and you may be injured while working with them. We could help you make a claim if a cow injures you.
