Is there a time limit for making an asbestos lung cancer claim?

The time limit for making a personal injury claim is normally three years. This time limit begins from the day you were diagnosed with lung cancer. If you learned later that your lung cancer was caused by asbestos exposure from your job, the three-year limit begins from this date.

If you’re claiming on behalf of a loved one who died, the limit is also three years. This starts from the date of their death.

Can I still make a claim for asbestos-related lung cancer if I smoke or used to smoke?

Yes, you can still make a claim even if you smoked. Smokers who are exposed to asbestos are at a greater risk of developing lung cancer.

If you smoked for a significant length of time, this may significantly reduce how much compensation you could claim. However, smokers aren’t excluded from being able to make a claim for asbestos-related lung cancer.
