Legionnaires' disease, a serious lung condition caused by infected water, is preventable with basic water management practices. If you've developed this avoidable illness while abroad, whether for work or a holiday, our lawyers could help you claim Legionnaires' disease compensation.

The disease is caused by bacteria called Legionella, which is fairly common in natural water supplies. However, when the bacteria are in the right condition to multiply, it can spread quickly and cause Legionnaires', a form of pneumonia.

There are two factors that help Legionella spread:

  • A water temperature between 20 and 45°C
  • A food source in the water for bacteria – such as limescale, rust or algae

Large buildings with more complex water systems – such as hotels, museums or spas – are at a greater risk of legionella contamination.

As the disease is usually preventable, you may be able to claim compensation if it was caused by the negligence of another party while abroad. Tour operators should ensure that hotels they use during your holiday are meeting health and safety standards, and should warn you of the risks.

1. Contacting Those Responsible For Your Illness
 
We'll help you work out who is responsible for your illness and get in touch with them at an early stage to see if they accept the blame for what happened. If they accept responsibility, we'll try to secure some of your compensation up-front, which can fund private medical care and expenses while your claim is ongoing. These payments are known as interim payments and will be taken out of your final compensation award.

Every case is different, so there's no set amount of compensation you'll receive. The amount of compensation you'll get will depend on your circumstances. This includes the severity of your illness and your chances of making a full recovery.
 
If you’re claiming after a loved one has passed away due to Legionnaires’ disease this will also be considered when making a compensation claim. 

Even if your accident or illness occurred abroad, you can often make a claim here in the UK, though this will vary depending on your circumstances. For example, if you suffered an accident or illness while staying in a hotel as part of a package holiday, you should be able to make a claim against the tour operator here in the UK.

You can also usually claim in the UK if you’re claiming against an individual insurer or employer that is based in the UK, or a business or insurer based in the EU. The law around compensation is different in each country, so we will consider where it would be best to make your claim in order to get the best possible result for you.

You normally have to make a personal injury claim within three years of your illness so you should contact us as soon as possible. 

Getting in touch with us shortly after your illness makes collecting evidence easier and helps get you the compensation you need as soon as possible. It can also help us find other people who may have contracted Legionnaires' disease from the same place and file a stronger group claim.
 
There are some exceptions to the three-year time limit, including:

• Claims on behalf of children - these can be made at any point before their 18th birthday. When the child reaches 18, they can make their own claim at any stage up until they turn 21.
• Mental capacity - there are no time limits to make a claim on behalf of someone who doesn't have the ability to handle their own case.
• Fatal claims - fatal cases of Legionnaires' disease can happen to people with underlying illnesses, people with weakened immune systems, with existing respiratory conditions and other vulnerable individuals. To make a claim on behalf of your loved one, you'll have three years from the date they died to make a claim. If a post-mortem found that the death was caused by the Legionnaires' disease, you have three years from the point where you discovered these findings.
• International claims - Most of the international personal injury claims we handle are made in England & Wales. But in some cases it may be beneficial to make your claim abroad, the time limits affecting your claim may therefore be different. Airlifted to Hospital From Luxury Cruise Airlifted to Hospital

We secured a five figure settlement for a retired man who had to be airlifted to hospital after contracting Legionnaires' disease on a luxury cruise.

Frank and his wife Patricia, both in their 80s, booked the cruise on the MS Black Watch for a relaxing holiday break together. The ship sailed from Southampton to the Cape Verde islands just off the coast of Africa. But just days into the trip, Frank began to get headaches and suffer from fatigue.

He was prescribed antibiotics on board but his symptoms only became worse. By the time they reached Cape Verde, his condition was so bad that he was taken to hospital for a chest x-ray.

Back on board however, he continued to deteriorate. He was airlifted by helicopter a hospital in Las Palmas and put in intensive care, where he was unconscious for three weeks.

Doctors confirmed he was suffering from Legionnaires. The disease is usually caused by water systems – like air conditioning units – not being maintained properly, and can be deadly in many cases. Frank's age made him especially vulnerable, and the whole experience was terrifying for both him and his wife.

Who Can Claim Compensation For Legionnaires' Disease?

If you've caught Legionnaires' disease while abroad, then you may be able to claim compensation. Sadly, the disease can sometimes be fatal, and you can claim compensation if a loved one has died from Legionnaires' too. 

Because the condition is easy to prevent by following proper health and safety procedures, cases are often the result of negligence on the part of someone else.

Legionnaires’ disease is not contagious, so if you or a loved one has been diagnosed, it must have come from inhaling particles of contaminated water. This means you may be eligible for compensation.

You usually have three years from the date you developed Legionnaires' to make a claim, although this time limit may be different depending on the country you were in when you contracted the disease. Because of this, it's important to seek legal advice as soon as possible.

What Is Legionnaires' Disease?

Legionnaires' disease is a form of pneumonia, caused by inhaling water contaminated with a large amount of the bacteria Legionella. Legionella is found in very small amounts in a range of natural water sources, but when it's in the right conditions inside man-made water systems, it can easily spread and grow to dangerous levels.

Initial symptoms of the disease are similar to flu:

  • Headaches and muscle pain
  • Fever
  • Chills
  • Loss of appetite
  • Tiredness and exhaustion

When Legionnaires' begins to develop, symptoms become more serious, in line with other types of pneumonia:

  • A persistent cough with greenish, or even bloody, mucus
  • Difficulty breathing
  • Chest pains

You may also have suffered from gastrointestinal symptoms such as vomiting and diarrhoea.

Legionnaires' disease can be treated with antibiotics, but in roughly 10% of cases the condition can be fatal.

What Are The Complications of Legionnaires' Disease?

The initial symptoms of Legionnaires' disease are easily confused with flu, but the disease can lead to severe complications. Those affected can develop symptoms of pneumonia, such as:

• A persistent cough, starting dry and potentially becoming phlegmy or bloody,
• Shortness of breath,
• Chest pains.

Severe infection can also cause organ failure or septic shock. These complications are fatal for an estimated 10% of otherwise healthy people who contract Legionnaires' disease.

Anyone in charge of a building has a responsibility to keep its water systems well-maintained and free of contamination. If you become ill because they’ve failed in their duty of care, you could make a claim for compensation.

Water should be cooled or heated to ensure that it isn't in the temperature 'danger zone' of 20-45C. It also needs to keep moving and be free of impurities.
