Carbon Monoxide Poisoning Claims

Trustpilot

The consequences of carbon monoxide poisoning can be fatal. If you or your loved one has had carbon monoxide poisoning because of someone else's negligence, our specialist lawyers could help you claim compensation.

Carbon monoxide poisoning can be caused by a range of things, including:

  • Gas boilers and other household appliances
  • Blocked chimneys
  • Burning fuel in an enclosed space
  • Faulty or blocked car exhausts
  • Paint fumes.

This isn’t a complete list, if you’ve had carbon monoxide poisoning from something else, contact our team to see if you can claim.

Employers, landlords, and other building owners all have a responsibility to make sure that appliances comply with safety regulations and that properties are well maintained. If your health has been endangered because someone has neglected this duty of care, we could help you bring a compensation claim.

What are the effects of carbon monoxide poisoning?

The symptoms of low-level carbon monoxide exposure can be like food poisoning or the flu. Unlike the flu, however, carbon monoxide poisoning doesn’t cause a fever.

Symptoms to look out for include:

  • Headaches - especially tension-type headaches
  • Dizziness
  • Nausea and vomiting
  • Tiredness and confusion
  • Shortness of breath and difficulty breathing.

When carbon monoxide enters the bloodstream, it prevents oxygen from being carried around the body, which causes vital cells and tissues to fail and die. Breathing in high levels of the gas can have more serious consequences, such as:

  • Impaired mental state
  • Vertigo
  • Breathlessness and chest pain
  • Seizures
  • Loss of consciousness.

While these symptoms are usually temporary, prolonged exposure to carbon monoxide could lead to long-term health complications, such as problems with memory and concentration, vision and hearing loss, and even heart disease.

Carbon monoxide poisoning claims - more information

We’ll first arrange for you to have a free initial consultation with one of our experts. Here, you can tell us more about what happened to you or a loved one. We’ll also discuss potential funding options with you.

There’s no pressure to continue with our service after this consultation, but if you do, we’ll start by gathering evidence. The evidence we gather will be different depending on your situation, but could be:

  • Medical records
  • Service records
  • Building records.

We might also use independent medical experts to assess what your care needs will be going forward. They’ll help us understand how much expense it could cost you for the support you’ll need.

Once we’ve got the evidence we need, we’ll take your claim to those responsible for your carbon monoxide poisoning. If they accept fault, we’ll work to close your claim quickly and try to get you interim payments. These can help cover any costs you’ve had but are taken from your final settlement.

If they don’t accept fault or don’t agree with the compensation we’ve suggested, then your claim might need to go to court. We try to avoid claims going to court but sometimes it’s the best way to get the best settlement for you.

Everyone uses their compensation for different things. The reason for this is everyone’s needs are different depending on the severity of their carbon monoxide poisoning.

Often, compensation will be used for:

  • Expenses - including travel expenses to medical appointments, prescriptions, and things that help with daily living.
  • Loss of earnings - to cover any time you've had off work and time off you may need in the future. This figure can also cover matters such as not returning to the same role or not being able to return to work.
  • Further treatments - to pay for any further medical procedures you may need.

Your needs might be different, but this is something our Support and Rehabilitation team will be able to help you identify.

With most carbon monoxide poisoning claims, you’ve three years from the date of your illness to make a claim. If you didn’t find out your illness was caused by carbon monoxide until a later date, you’ve three years from the date you became aware to then claim compensation.

There are some exceptions to the three-year rule, these are:

  • International claims – time limits in other countries might be shorter than three years.
  • Claims on behalf of children – you can claim anytime up until their 18th birthday. They’ve got three years from their 18th birthday to make their own claim.
  • Claims on behalf of someone who lacks mental capacity – there are no time limits for someone who doesn’t have the mental capacity to claim on their own behalf.

If you’ve any questions about time limits, we’ll be happy to offer more guidance when you contact us.

Yes, you can claim if your loved one has passed away from carbon monoxide poisoning. We can help you claim compensation for their death and get any support you need.

Contact our team and we’ll advise you how we can help

We do accept no win no fee carbon monoxide poisoning claims, although these are offered on a case-to-case basis. We might be aware of a funding option that’s better for you and will let you know if that’s the case.

If we do think your claim is suitable for a no win no fee agreement, we’ll help you set one up. You’ll have to get an insurance policy that’ll protect you during your claim and doesn’t cost anything extra to set up.

Frequently asked questions

What is carbon monoxide?

Carbon monoxide is a colourless and odourless gas that’s produced in several ways. If breathed in, it can make you seriously ill. At its most severe, carbon monoxide poisoning can be fatal.

While it’s in everyday things (paint fumes or car exhaust fumes), its most severe form is from poorly maintained gas heating or poor ventilation around open fires.

What causes carbon monoxide leaks?

Carbon monoxide is produced when fuels such as gas or coal don’t burn properly. Carbon monoxide leaks happen most commonly when household appliances are incorrectly installed, poorly maintained, or poorly ventilated.

Many household appliances run on fuels that produce carbon monoxide, including:

  • Boilers
  • Gas fires
  • Central heating systems
  • Water heaters
  • Cookers.

If you've had carbon monoxide poisoning because these appliances have been fitted badly or failed to meet proper safety standards, we could help you make a claim against those responsible. This could involve bringing a claim against:

  • Landlords or building owners
  • Employers
  • The company fitting or servicing appliances.

If you're unsure of where your exposure to carbon monoxide happened, or who’s responsible, you can contact our expert team today for a free consultation. We'll be happy to talk to you about your claim, with no obligation.

How do I know my illness is caused by carbon monoxide poisoning?

Carbon monoxide has no smell or taste, making it hard to detect. It's very important to identify a leak as soon as possible. This is because the longer you're exposed to the gas, the more severe your symptoms will be, and the greater the risk of developing long-term complications.

Many homes are fitted with carbon monoxide detectors, and landlords have a legal responsibility to make sure they’re fitted in rooms with solid fuel appliances. However, it’s good to be aware of the symptoms in case detectors aren’t fitted or are faulty.

You should suspect carbon monoxide poisoning if:

  • Other people in your house, flat or workplace fall ill with similar symptoms
  • Symptoms disappear when you leave the property and come back when you return
  • You get headaches more often when the central heating is on - such as in winter
  • Pets also become ill.

You can also look out for visual evidence of carbon monoxide. These might include:

  • Black, sooty marks on the front covers of gas fires
  • Sooty or yellow/brown stains on or around boilers, stoves, or fires
  • Smoke building up in rooms (due to a faulty flue)
  • Gas appliances give out yellow flames instead of blue ones.

If you suspect carbon monoxide poisoning, you should switch off appliances immediately and seek medical attention.
