What types of knee replacements have been found to be defective?

We've successfully represented clients in claims involving a range of knee replacements.

Sometimes, a knee replacement fails because it was fitted incorrectly, rather than because of problems with the device. We look at each case individually, with input from expert orthopaedic surgeons, to identify the cause of failure and make a claim against the party responsible. This could be the manufacturer of the device where the reason for failure is a defective product, or the hospital trust where the surgeon is at fault.

Is there a time limit to make a claim?

In the UK, the usual time limit for any medical negligence claim is three years. The limit begins on the date your knee replacement was fitted. If your problems didn’t start straight away, the three-year limit might begin later, but you’ll need legal advice to confirm this.

If you had knee replacement surgery outside of the UK, the time limit may be shorter.

There's a separate time limit for product liability claims of 10 years from the date the product went into circulation. You'll need legal advice to establish when that date expires. This time limit is in addition to the three-year time limit, and applies to all claimants, including children or adults without mental capacity.

It’s always advisable to make your claim as soon as possible. This gives us the maximum amount of time to start investigating your case. The details will be fresher in your mind, and it’ll be quicker for us to gather evidence.

What is a group claim and what are the benefits?

If a whole batch of medical products proves to be defective, many people can sustain injury or illness. When this happens, it’s possible to make a group claim, which makes sure everyone is fully compensated fairly.
