What Is No Win No Fee?

A no win no fee agreement (also known as a conditional fee arrangement) allows you to make a compensation claim, with no financial risk and without paying any solicitors’ fees upfront. You only ever pay anything if your no win no fee claim is successful. If your case is unsuccessful you won’t have to pay any legal fees – either to your own solicitor or to your opponent’s.

How Does A No Win No Fee Claim Work?

Making a no win no fee claim usually involves us taking out an insurance policy on your behalf.

This insurance policy fully protects you if your claim is unsuccessful. It also means that you can claim compensation without paying a penny upfront.

You only ever pay anything if your no win no fee claim is successful, and even then your opponent will pay most of your legal costs. Any remaining costs are deducted from your compensation settlement. We’ll advise you of this in advance, so there won’t be any surprises.

Which Types Of Personal Injury Claim Can You Make Using A No Win No Fee Agreement?

A no win no fee agreement could be used for any type of personal injury claim, including:

  • Medical negligence
  • Serious injury

  • Accidents or illness abroad

  • Industrial diseases
  • Asbestos related diseases

Can You Make A No Win No Fee Claim?

Most of the personal injury claims we handle are paid for using a no win no fee agreement.

We can then discuss the options for funding your claim. Most people will use a no win no fee agreement, but you might already have legal cover (through legal expenses insurance on your home/car insurance, or through being a member of a trade union).

What Happens If You Lose Your Case?

If your claim is unsuccessful you won’t pay anything. We won’t charge you, while your insurance policy will cover your opponent’s legal fees and costs.

How Much Will You Have To Pay If You Win?

If you win your case your opponent will pay most of your legal costs.

Any legal costs not paid by your opponent will be deducted from the compensation that you receive. These costs include:

  • Some of your basic legal costs which can’t be recovered from your opponent
  • A “success fee” which compensates us for the risk that if your claim was unsuccessful then we would not be paid at all.

This time can be used as an opportunity to understand the impact that your injury or illness has had on you and your family. This discussion will be important to confirm if you are able to progress a legal claim. We’ll discuss what funding options are available to you to pay for your claim, including No Win No Fee agreements*.

Our specialist lawyers will look into your case in detail, gathering evidence from independent medical professionals and other specialists. These experts will analyse how your injury or illness occurred and any long term impact on your well being. They’ll also advise us on the rehabilitation and care you’ll need in the future.

We’ll be in touch also with those responsible for your injuries or illness. If they acknowledge responsibility for what has happened to you early in the process, we’ll try to secure interim compensation payments (where appropriate) which can fund any immediate care, rehabilitation, expenses or adaptations . Any interim payments awarded to you will be taken out of your final compensation award.

We’ll always try and negotiate claims out of court. However, if your opponent doesn’t accept responsibility or doesn’t agree with the amount of compensation we feel you need, we’ll start court proceedings.

In general, you have three years to make a claim, from the date your injury happened or from when you first became aware of it. For children, the three year time limit begins on their 18th birthday.

These time limits do not apply to people who are unable to manage their own affairs because of mental incapacity.

There are also different time limits if your injury or illness happened outside of England and Wales – for example, during international travel or if a defective product is involved. Time limits will vary and can often be much shorter than three years. No Win No Fee agreements can still be used to fund cases involving an injury abroad.

What Other Funding Options Are Available?

There are a number of other ways in which you could fund your case in addition to No Win No Fee agreements. These include:

  • Legal expenses insurance – as part of your household or car insurance you may have legal expenses cover to help with any legal costs.
  • Trade union – if you’re a member of a trade union they may provide assistance for some legal issues.
  • Legal aid – this is now only available in cases for children with brain (neurological) injuries resulting in severe disability, which arise during pregnancy, childbirth or up to eight weeks postnatal.

If you don’t have legal expenses insurance or trade union help, your best option is to consider a No Win No Fee agreement. Even if you do have access to other funding options, a No Win No Fee agreement may still be the best option for you.
