How can medical negligence result in an amputation?

Amputations can be performed for a wide range of different medical reasons. It’s normally when a limb has been badly injured in an accident or when the area has a serious infection. However, sometimes you may need a limb amputated because a medical professional didn’t treat a pre-existing condition or injury correctly.

We can help you if you’ve had to have a limb amputated because of the following negligent treatment:

  • Ischemia wasn’t diagnosed (reduced oxygen supply to the limbs)
  • Infected wound or laceration not diagnosed/treated correctly
  • Improper care of diabetes, resulting in complications (including diabetic foot ulcers)
  • Undiagnosed cancer in your limb
  • Misdiagnosis of meningitis
  • Nerve, muscle, or tendon damaged during surgery
  • Amputation of the wrong limb.

Amputation Negligence Claims - More Information

After you first contact us, we’ll arrange a free consultation where you can explain what’s happened to you to one of our specialist solicitors. We’ll advise you on if you can make a claim, what the next steps are, and what possible funding options are available.

If you decide to use our services, we’ll start by gathering evidence to build your case. This could be medical records or witness statements. We’ll also use independent medical experts who can advise us on the care you should have received and how your life will now be impacted.

We’ll then present your case to those responsible for your negligent amputation. If they accept fault, we’ll go to them with our compensation figure. If they also accept that, we’ll work to quickly settle your claim. We can try to get interim payments that can cover any medical expenses and loss of earnings. Any payments will be taken from your final compensation amount.

If they don’t accept fault or disagree with our compensation amount, we can take your claim to court to resolve it. We’ll always try to avoid going to court, but sometimes it’s the best option. Claims can still be settled out of court, even when a trial date is set. We’ll be by your side every step of the way.

Every claim is different, so it’s hard for us to advise how long your claim will take without knowing specific details. When you tell us more about what happened to cause your amputation, we can offer more guidance on how long your claim will take.

The usual time limit for making an amputation claim is three years from the date of the negligent treatment. It can also be three years from the date you realised you received negligent treatment that resulted in your amputation.

There are some exceptions to this rule, these are:

  • You’re claiming on behalf of a child – you’ve until they’re 18, and then they’ve got until their 21st birthday to claim
  • Claiming on behalf of someone who lacks mental capacity – there are no time limits in these circumstances.

Molly enjoyed an active life. She enjoyed running and swimming and was building her career as a support worker in a residential home. Molly told us: "I was so active; I was never at home. Life was really good."

What can compensation pay for?

Compensation can be used to make everyday life easier, helping you maintain your independence and make the best recovery possible.

In cases where a leg or arm has been amputated, compensation often pays for advanced prosthetics to enable you to be as independent as possible. Prosthetic limbs can be very expensive and will need several meetings with a prosthetic consultant. They’ll make sure that your leg is properly fitted and who’ll train you how to walk with the device.

By claiming compensation, you can often pay for better quality prosthetics than those available from the NHS.

Compensation can also be used to pay for:

  • Psychological help – getting used to life with a disability/prosthetic limb and support with phantom limb pain/sensation
  • Home visits from healthcare professionals
  • Physiotherapy
  • Financial implications – help with lost earnings, travel expenses to medical appointments etc
  • Adaptations to your home and vehicle
  • Specialist equipment – advice from an occupational therapist on what devices can help with everyday life.

How much compensation can I expect?

Each amputation negligence claim we handle is different, and every person who’s experienced an amputation will face their own unique challenges.

The amount of compensation you’ll get will depend upon your circumstances, ensuring that you have access to the care, support, and equipment you need.

It’s hard to predict exactly how much compensation you’ll be able to get, but we can provide an estimated figure after we’ve examined your case.

There are three main amputation types, and each one presents its own set of life challenges:

  • Leg and/or foot – This sort of amputation often requires a prosthetic or the use of a wheelchair. Compensation can be used to pay for physiotherapy to counter any muscle imbalances and to ensure that you get a high-quality prosthetic limb. Funds can also cover any loss of earnings that you might incur if you can no longer work or pursue the same job role.
  • Arm and/or hand – If your dominant hand is amputated, you can sometimes expect more compensation because this injury might be seen as more severe. This is due to the fact you’ll need to learn to write, carry and do tasks with your less dexterous hand. You might also need to adjust to using a prosthetic limb, which could hinder your ability to perform everyday tasks and your job role.
  • Toe or finger – Having a toe amputated can affect your balance, your ability to run or walk long distances and even your ability to stand for a prolonged amount of time. The amount of compensation you receive can be affected by which toe is amputated, as losing your big toe can have more serious effects. Finger and thumb amputations can require funds to compensate for your reduced ability to grasp and can be used to pay for reconstructive surgery of the muscle.
