Bus & Coach Accident Claims

Trustpilot

If you’ve experienced a physical or psychological injury due to a bus or coach crash, you can claim compensation.

Our solicitors have a great deal of experience in coach and bus accident claims. We’ve a team of specialist road traffic accident lawyers who've successfully claimed compensation for individuals who’ve sustained injuries in bus or coach accidents, both in the UK and abroad. We’re also leading experts in representing groups of individuals who've been injured together in major incidents.

Contact our team of expert solicitors to see if you make a compensation claim. We can take many bus or coach accident claims on a no win no fee agreement. These are offered on a case-by-case basis, we’ll let you know at the start if we think your claim is suitable for one of these agreements.

Bus and coach operators have a duty of care for the safety of their passengers whether they’re a public transport operator, private hire company, coach tour operator, or school bus service provider. This is the same both in the UK and overseas.

Why choose Irwin Mitchell to help with your bus or coach accident claim?

We’re one of the UK’s leading personal injury firms, this includes our team of road traffic accident solicitors. We’ve secured over £1.5 billion in compensation for our clients in the past couple of years. All of which has been used to help clients access the best support and make the best possible recovery.

Our road traffic accident teams have over 30 years of experience securing compensation and support for our clients after a bus or coach accident. We understand that even though the introduction of seatbelts on coaches has reduced the risk of injury, there’s still the chance of serious physical and psychological injuries.

Our offices are located around the UK, which means there’ll be experts in your local office. We can also arrange phone or video calls if this is easier for you, or we can meet you at an appropriate location.

We also understand that the key to making a positive recovery is having the right support. Our Support and Rehabilitation Coordinators are trained medical experts who’ll help you identify and access the support you need. This could be:

  • Physical support
  • Emotional support
  • Financial support.

While your claim is ongoing, our welfare benefits team will be on hand to help you understand if you’re eligible to access any specific support. This can be useful if you can no longer work or have had to take a lower-paid role while you recover.

We’ll also be able to set you up a personal injury trust. This’ll make sure your compensation doesn’t impact any means-tested benefits you’re able to claim now or in the future.

When you do receive your compensation, you might have questions about making sure the money is there when you need it. Our Asset Management team are financial experts who can help with money management and answer any questions you have about investing your compensation.

Bus & Coach Accident Claims - More Information

Each bus or coach accident claim will result in a different amount of compensation because of the unique set of circumstances in each claim. For this reason, we can’t give you an estimate of how much you could claim until we know more about what’s happened to you.

When valuing your claim, we’ll often consider:

  • The type and severity of your injuries
  • Your pain and suffering
  • Current and future loss of earnings
  • Medical and travel expenses you have incurred
  • Your care and support needs – both now and in the future
  • Modifications to your home.

Some of these might not apply to your claim, or there might be other things we need to consider.

You can be assured that we make sure everything that needs to be considered will be before we take a settlement amount to the other party.

We do take bus or coach crash claims on a no win no fee basis. This means there’s nothing to pay upfront, and you’ll not pay anything if your claim is unsuccessful.

These agreements aren’t suitable for everyone, so we’ll discuss the details with you before we start your claim.

There are other funding options available that could be better for you. We’ll discuss all of this with you during your free initial consultation.

As with most road accident claims, you’ll have three years to make a claim for compensation after being involved in a bus or coach crash.

There are some key exceptions to this rule:

  • Accidents abroad – if your accident happened abroad, the time limits might be shorter or longer.
  • Children – there are no time limits if you’re claiming on behalf of a child. When they turn 18, the three-year time limit starts, so they must claim during this time.
  • Mental capacity – if you’re claiming on behalf of someone who lacks mental capacity, there are no time limits to making a claim.

If you’ve any questions about time limits, you can ask these during your free initial consultation.

We work alongside several road traffic accident charities that can provide you with added expert support during and after your claim. The charities include:

  • Aftermath
  • Brake
  • RoadPeace.

Client Story ‐ Coach crash abroad

Sharon was a passenger on a coach in Spain. The coach driver appeared to be asleep, Sharon removed her seatbelt to make sure the driver was still awake. As she did so, the coach swerved across the motorway and as the driver tried to correct the coach, he lost control.

The coach hit the guardrail and collided with a tree and lamppost, leaving the coach on its side on a verge.

Sharon's injuries left her unable to carry on working as a radiographer for the NHS. She left the job she loved and had to take a lower paying job.

After being unsatisfied with the work of another law firm, she came to us. We were able to reach an agreement for Sharon before the trial, meaning she didn't have to go to court. Sharon received a large settlement to reflect her pain and suffering, as well as cover any future treatment. It also reflected past and future loss of earnings due to her career change.

Find out more about Sharon's case.

Frequently Asked Questions

How do I claim after a bus accident?

The first thing to do to start your claim is contact our team. We’ll arrange a free initial consultation with an expert bus or coach accident solicitor. They’ll learn more about what’s happened to you and let you know whether you can make a claim.

There’s no obligation to use our services after this consultation, but if you do decide to, we’ll start by gathering evidence to build your claim. This could be:

  • Witness statements
  • Medical records
  • Police reports
  • CCTV (if available).

We’ll then present your claim to those we believe to be responsible. If they accept fault, we’ll present a compensation amount to them and start work to settle your claim.

If they don’t accept fault or the amount of compensation we present to them, we can start court proceedings. We’ll try to avoid your claim going to court, but sometimes this can be the best way to get the best outcome for you.

Our experts will be by your side each step of the way, making sure you’re fully informed throughout.

Can I claim compensation for bus or coach accidents that happened abroad?

If you were abroad at the time of your accident, whether on holiday or for work, you may still be able to claim compensation.

However, the time limit you have for claiming may be shorter than if your accident happened in the UK. As a result, it's important that you contact us as soon as possible to begin the claim process.

Many claims can be made in the UK, and if your claim does need to be made abroad, we’ve many years of experience with foreign legal systems, so you don't need to worry. We’ll be there to support you every step of the way.

Can I make a group claim following a bus or coach accident?

When you make a bus or coach accident claim with us, there’s more than one way you may be able to pursue it. You can claim for compensation individually, or you may be able to make a claim as part of a group.

Due to the nature of accidents involving public transport, there are often many people injured in the same incident. Sharing your experience with others can be helpful when it comes to claiming compensation.

If you were one of a group of people injured in a coach accident, there may be advantages in making a claim together. Multiple accounts of the accident and a united voice for those affected can help when it comes to achieving compensation.

Can I get early compensation payments to help fund my rehabilitation?

If the other party accepts fault for your injuries, we’ll be able to apply for early compensation payments, which are known as interim payments.

These can be used to cover any lost earnings and help pay for early support to help with your recovery.

Any interim payments you do receive will be taken off your final settlement amount.
