What If The Driver Failed To Stop?

It’s not always possible to get the driver’s details in the event of a serious road accident. This might be because they drove off or you needed immediate medical attention and were unable to get their details. Whether the driver can be identified or not should not influence how much compensation you can claim.

If they can be identified and they were at fault, their insurer or the Motor Insurers’ Bureau (if they’re uninsured) will ultimately be responsible for paying your compensation. If they can’t, we can help you make an application to the Motor Insurers’ Bureau under the Untraced Drivers’ Agreement without affecting the amount you’re entitled to because of your accident.

Can You Make A Pedestrian Accident Claim On Behalf Of A Child?

You can claim on behalf of your child if they are too young to claim themselves. Claims involving children usually take a few years to settle. This is because the full extent of their injuries may take time to appear as they grow.

Pedestrian Accident Claims Time Limits

The typical time limit for starting a personal injury claim is three years from the date of the incident, but it’s best to start your claim sooner rather than later.

The sooner you start, the fresher the evidence and witness statements will be, which can only help your case. We can also start the process of getting you access to specialist rehabilitation and support services. In some cases, we may be able to get interim compensation payments to help you with any immediate costs. These might cover treatment or lost earnings because of the injury. There are some exceptions to the usual time limit of three years, including:

  • Claiming for children: This can be done any time before their 21st birthday
  • Claiming for a person who lacks the mental capacity to claim for themselves: There is no time limit on these cases
  • Claiming for criminal injury: This must be done within two years
  • Making international claims: Time limits in other countries may be shorter.

What To Expect When You Make A Claim

If they accept liability, then we can try to get you an interim compensation payment. This is a payment that’s made while your claim is going through, to pay for your day-to-day expenses and to replace lost earnings if you’ve been unable to work.

While the legal process is happening, you’ll get access to one of our Support & Rehabilitation Coordinators. They can help you with things like putting you in touch with a specialist therapist or recommending a local tradesperson if you need to make modifications to your home.
